What Is FSSAI Registration & FSSAI License

FSSAI license or FSSAI registration: FSSAI stands for Food Safety and Standards Authority of India, which is an autonomous body set up under the Government of India’s Ministry of Health & Family Welfare. A 14-digit license number is issued by the Food Authority of India to food business operators who comply with the rules and regulations under the FSS Act, 2006.

This FSSAI License number, along with the FSSAI Logo, must be printed on food items. Before starting any food company, an FSSAI license or FSSAI registration is mandatory.

For all food-related enterprises, such as producers, distributors, restaurants, small eateries, grocery stores, importers, exporters, home-based food businesses, dairy farms, processors, retailers, e-retailers involved in the food industry, FSSAI registration is required.

How Many Kinds of FSSAI License in India

  • Basic License: For businesses with a turnover below INR 12 Lakhs.
  • State Licence: For businesses with a turnover of more than 12 Lakhs and a turnover of less than INR 20 Crores.
  • Central License: For businesses with a turnover higher than INR 20 Crores.

What Is The Process FSSAI Registration ?

1. Consultation

2. Documents submission

    1. Do I need FSSAI License for both Import and Export?

    Yes, an FSSAI license is necessary for both import and export of food items.

    2. Is FSSAI license mandatory?

    All types of food manufacturers, food packaging units, and food storage units, whether individuals or entities are necessary to obtain FSSAI registration or license in compliance with the Rules and Regulation of the Food Safety and Standard Act, 2006.

    3. Is FSSAI license required for distribution as well?

    Whether you manufacture, distribute, transport, or trade food additives, you will require an FSSAI license in order to do it.

    4. What is the fee of application for modification of FSSAI license?

    For change of any information contained in License or registration certificate – Form C, a fee equivalent to the fee of one-year new license or registration is applicable. No fee is required for modification of non – Form C details.

    5. How to renew the FSSAI license after expiry?

    FSSAI license or registration cannot be renewed if it is not applied within 30 days from the expiry of license/registration. Once the license/registration expires, FBO has to apply afresh.

    6. What License is required to carry out different kind of food business activities at the same premise?

    FSSAI license is based on premises. All kinds of food business activities which are being carried out at the same premise can be applied for in a single FSSAI license.

    7. Which Food Businesses are eligible for FSSAI registration and by whom is it issued?

    FSSAI Registrations are granted to petty or small Food Businesses whose turnover is less than Rs. 12 lakhs per annum. The registration certificate obtained in Form C is required to be displayed in the food business premise at a prominent place. The registration is issued by the Authority who may be a Food Safety Officer or a Designated Officer or any other official in Municipal Corporation or any other local body or Panchayat in an area. These officials are notified by the State Food Safety Commissioner.

    8. What is Improvement Notice and who issues it?

    An improvement notice is if a Food Business Operator fails to comply with the food regulations set in the FSS Act, 2006. An improvement notice can be issued by a Designated Officer (DO) of the food safety department.

    9. When can a DO suspend the license?

    If the food business operator has failed to comply with an improvement notice, his licence can be suspended by the DO, after allowing him to show cause.

    10. Can an appeal be filed against an Improvement notice, suspension/ cancellation of license?

    Yes, any Food Business Operator (FBO) can appeal to the State Commissioner of Food Safety, if he/she is aggrieved by the improvement notice or suspension/cancellation of licence. The decision of the Food and Safety Commissioner shall be final. Alternatively, an FBO can also approach the Food safety Appellate Tribunal/ high court of their respective States/UTs to challenge the notice.

    11. What is the time frame for appealing to the State Commissioner of Food Safety?

    Any FBO can appeal to the Commission of Food Safety within 15 days from the date on which a notice of the decision was served.

    12. How to renew your license/Registration after expiry?

    You need to renew your FSSAI license online before the expiry of its validity period. In case you end up missing the date of renewal of the application, you will have to apply for a fresh FSSAI license if you wish to continue your food business operations.

    13. Can I convert a manually issued license to online and How?

    Yes, you can convert a manually issued license to an online one during the renewal process. You can approach the concerned Designated Officer of that area. A Designated Officer can then create a USER ID and issue a system-generated license number which can be renewed through an online process to you.

    14. Can a license be modified? What is the fee for such modification?

    If you intend to make changes to your license, you can do so. If you wish to make changes to the information in Form C a modification fee may apply which is equal to a one-year license fee. There are no charges levied for changes to other parts of the license.
